The EPA continues to insist on fining refiners for failure to add cellulosic ethanol to gasoline, despite the fact that no cellulosic ethanol is available.
The API has now filed a second action against the EPA over this issue.

rjhenn claims:
"Interesting that these requirements that so many are moaning about were set out by Congress in 2005 (the Energy Policy Act of 2005). Who was in charge then?
Oh, wait, that was the Republicans!"
The real story here, in case you might have missed it, is about "practical", not political. Back in 2005, when the policy was first considered, no cellulosic ethanol was being produced, although the technology to do it goes back to the era of WWI, and German technology.
In 2005, the DOE acknowledged that research was necessary in order to make cellulosic ethanol "practical". Today, while the same technology is still available, it costs roughly twice as much to make a gallon of ethanol from cellulose, rather than corn, which is why there is no commercially available cellulosic ethanol available.
Recognizing that despite efforts to subsidize research to make cellulosic ethanol practical, it still remains too expensive by a factor of 2, the EPA has twice reduced the cellulosic mandate. Since the ethanol STILL isn't available yet, it really needs to reduce the requirement and fine to zero until it is. Fining fuel producers for failing to add an unavailable component just raises our fuel cost unnecessarily. Don`t we already pay enough for a gallon of fuel?

SandeeC asks a reasonable question:
"Why is it that whenever something to do with gas and/or oil is involved that governments, companies, industries, etc. etc. that the cart is always put before the horse?"
Because the policy to require cellulosic ethanol was conceived to meet a politcal, rather than a practical agenda, AND, the bill was drafted by ethanol interests.

If cellulosic ethanol is not being produced and it is required, then it can't be added. So what's the problem? Don't worry, Be happy! Whatever the size or shape of the vehicle, Produce and ‘Drive’ vehicles with high MPG, are very safe and reliable, have a ‘reasonable’ cost and a good ‘value’ for the money. Consider using other forms of less expensive transportation to lower your cost, if possible. The price of fuel at the pump is too high! 12/22/2012!

epa trying to shut down coal mines that produce 14 percent of americas electrical power while laying off 9000 power company workers and that does not include the 14 mines they are trying to shut down in west by god virginny.stupid epa killing america while driving up power cost exponentially.if the mines do not get this scrub their coal. : ) pure genius add costs to coal production so coal power costs ared riven up even if they comply witht he epa.this is almost as laughable as making companies produce less carbon dioxide, while all plant life on the planet needs it to produce air/oxygen which humans need to live, not to mention the plant life we eat and also our livestock consumes that we eat.just shows the pure genius of the epa.i wish someone would audit the epa and see if they are even following these asinine rules they are trying to make others follow.

Too bad ethanol of any sort has not become a “phantom fuel.” Better off without it.

The EPA is one of the worst examples of its kind. It's the last place you'd expect to find any intelligence trying to protect anyone's environment.

Bush didn't get everything right either. The EPA is very overbearing and is a heavy weight on the economy.

Hard to believe that FoxNews left out one little detail: The EPA is just trying to follow the rule in an act signed into law by George W. Bush, the 2005 Energy Policy Act (H.R. 6). You can look it up.
